Landlords Gas Safety Responsibilities

Are you aware of landlords gas safety responsibilities? If you rent your home, your landlord has certain legal responsibilities relating to gas safety. Gas flues, pipework and appliances must be maintained in a safe condition. If your landlord provides you with gas appliances to use, then they must be checked once a year by a qualified and registered engineer under the Gas Safe scheme.

Landlords have three duties to keep tenants safe:

Landlords’ Gas Safety Responsibilities – Annual Gas Safety Checks

To ensure that any gas appliances provided for their tenants are safe to use. They must arrange for annual safety checks by a Gas Safe registered engineer.

Landlords’ Gas Safety Responsibilities – Records

The landlord has to keep a record of the annual gas safety check – including specific information about the results. A copy of the gas safety record has to be provided to the tenant within 28 days of the check taking place, or immediately to new tenants when they move in. The records have to be retained for a period of two years.

Landlords’ Gas Safety Responsibilities – Maintenance

Regular inspections must be carried out, and any necessary repairs carried out promptly. Landlords must make sure pipework is in a safe condition, and those gas appliances and flues are serviced annually or in accordance with manufacturer’s instructions. There are no formal rules saying that records have to be kept of maintenance, but it is a good idea for landlords to do so. Tenants do not need to be provided with records relating to maintenance and repairs.

Gas Appliances owned by Tenants

Tenants should ensure that the landlord is granted access to the property to complete these gas safety checks. There is no obligation on landlords to have gas appliances that belong to their tenants checked. Tenants are responsible for the safety of their own appliances. It is recommended that tenants have their appliances checked for gas safety once a year by a Gas Safe registered engineer.
